GENERAL CONDITIONS FOR THE RENTAL OF A HOUSING BY SEASON THAT GOVERN BETWEEN YOU. (hereinafter "The Client") AND THE PROPERTY OF THE HOUSING, WITH THE INTERMEDIATION OF "Vacation rental management Apartamentos 77 S.L. (Hereinafter APARTAMENTOS77.COM)

1.- Payment and contracting conditions

The User ("The Client") declares to be of legal age and have sufficient legal capacity to be bound by these Conditions. "The Client" may make their reservation through the website www.apartamentos77.com or by phone. In the shortest possible time you will receive confirmation of it in writing, preferably via e-mail. The Client, within 48 hours following the confirmation of the reservation, must make the payment on account of the amount indicated in the accommodation conditions, declaring, from that moment, the knowledge and acceptance of these "general conditions ". The rest of the rental amount must be paid prior to entering the house in accordance with the conditions indicated on the accommodation page.

Said payments may be made by bank transfer, credit / debit card through a secure payment gateway with an SSL (Secure Socket Layer) connection, or through the Paypal payment platform.

In cases of direct reservations or through the web www.apartamentos77.com, Airbnb.com or Booking.com, "APARTAMENTOS77.COM" reserves the right to cancel the reservation in case the client has not made the payment on account indicated in the lease conditions within 48 hours.

Reservations made through portals owned by third parties, such as Booking., Airbnb, etc. who manage the payment with the client, will be subject to the payment / cancellation conditions of the aforementioned portals, without "APARTAMENTOS77.COM" having any responsibility in this regard.

2.- Services and prices

The prices published by "APARTAMENTOS77.COM" are per day and accommodation on the indicated dates.

The minimum rental is 2 nights. The price includes the supplies available to the accommodation, as well as the cleaning of the house upon entry and exit of new clients

The rented homes are furnished and equipped with the necessary appliances and equipment for immediate use to the number of places in it. They are delivered with bedding, household items in general, a first aid kit, a cleaning kit, a hand and shower towel per person and 2 rolls of toilet paper, plus a replacement set.

In long-stay rentals (hired for a period of more than two months, computed continuously by the same user), prices refer to calendar months. For this type of rentals, electricity and gas supplies are not included in the price, "The Client" running with said expenses, which will be billed based on the consumption measured by the meters and with the rates of the energy providers. . In any case, the extra expenses that "The Client" must assume will be detailed by "APARTAMENTOS77.COM" in the written confirmation of the reservation.

"APARTAMENTOS77.COM" will provide the necessary information for the correct use / operation of electrical appliances or other devices, internal rules regarding the use of facilities, dependencies and equipment, admission of pets, as well as other restrictions and all the details of the characteristics of the road and access to the house.

The general information of interest that is provided for each locality (tourist information about the area, entertainment venues, restaurants and cafeterias, shops, nearby parking lots and / or existing medical services, means of urban transport, etc.) is periodically updated. "APARTAMENTOS77.COM" is not responsible for the supervening variations, nor for its perfect correspondence with reality.

Neither will it be responsible for any interruptions that may occur in internet / WIFI or satellite television services and / or variations in the programming of its channels.

The prices offered are final and complete, including taxes, breaking down, where appropriate, the amount of the increases or "extras" applicable to the offer and the additional expenses that will be passed on to the client.

3.- Modifications of prices and benefits

"APARTAMENTOS77.COM" publishes the descriptions and prices of the leases on its website. Although it makes every effort to ensure that such data corresponds to reality, in some case some variation may occur, which will be communicated to "The Client" upon confirmation of the reservation.

In the event that said variations occur after the confirmation of the reservation, "The Client" may terminate the contract, free of charge on his part, within 7 days following the confirmation of the same, being him reimbursed the total pago effected.

4.- Entrances and exits of "The Client" to the rented house

To make use of the house "The client" must present their identity document in order to comply with current regulations on registration books and entry parts of travelers.

The entries in the rented house must be made from the time indicated in the accommodation conditions, having to leave the house before the time also indicated in the conditions of the end of the same. In this regard "APARTAMENTOS77.COM" will duly inform "The Client" about the delivery and collection of the keys to the house. With prior written confirmation from "APARTAMENTOS77.COM", "The Client" can request a delay in his departure until 6:00 p.m., in this case he must pay a supplement depending on the type of accommodation for management expenses, an amount that will be informed at the time of hiring.

In the event that "The Client" for reasons beyond the control of "APARTAMENTOS77.COM" could not occupy the house on any of the agreed days of lease (early arrival or departure), the latter will not make any refund to the former.

If "The Client" wishes to extend the stay, he must request it at his reservation office as soon as possible, being confirmed or denied depending on the availability of accommodation by "APARTAMENTOS77.COM".

5.- Cancellation of the contract by "The Client"

"The Client" may cancel the reservation prior to the start date of the lease, with the following penalties:

* From the date of confirmation of the reservation until 14 days before the start date of the rental, you must pay 10% of the total amount of the rental.

* From the 14th day prior to the start date of the lease, you must pay 50% of the total amount.

* From the 30th day prior to the start date of the lease, you must pay 100% of the total amount.

The cancellation will be considered made from the moment "APARTAMENTOS77.COM" or its agent has received your request in writing.

If there is a cancellation of the reservation, both by the user and by the person or operating entity, for reasons of force majeure, duly justified, no penalty may be applied.

Forces of force majeure shall be understood as circumstances beyond the control of the person invoking them, abnormal and unforeseeable, the consequences of which could not have been avoided, despite having acted with due diligence.

Our terms and conditions are not affected by the current situation in Corona. If a travel ban is imposed for Spain in your country, your reservation will be canceled and the amount paid will be refunded. For inland guests, a legal travel ban must be issued by the government within Spain in order to cancel the reservation for free.

6.- Alternative or cancellation of the contract by "APARTAMENTOS77.COM"

In cases of force majeure or supervening impossibility to rent the home, "The Client" may choose, when technically possible, between replacing the rented home with another of similar characteristics, or canceling the contract with a refund of the total amount. delivered.

7.- Obligations of "The Client"

The number of people with access to the rented house will be those that appear in the contract or confirmation of the reservation, counting children or babies in this regard, and the property or property manager may prevent access to it if exceeds the agreed number.

Before arrival, "The Client" must provide "APARTAMENTOS77.COM" with their credit card details (Visa, MasterCard, etc.). On the day of entry to the house, "APARTAMENTOS77.COM" will make a withholding on said card, which depending on the accommodation will range between 100 and 1000 Euros, without prejudice to its specific determination. Said amount or deposit will not be charged to the account. client, but will simply be "retained" until departure, at which time such retention will be canceled, once the lease is completed, deducting, where appropriate, the amount of damage that may have been caused to the home, its furniture and Appliances, loss of keys / remote controls, or electricity / gas supply costs in the case of long-term rentals. In the event that the amount of the retained deposit does not cover them, the customer will be charged the difference in the credit card provided.

In any case, the retention initially made on the credit card will be rendered ineffective within the72 hours after the termination of the lease.

At the end of the lease "The Client" undertakes to leave the house in the same state of order and cleanliness that it had at its entrance (for guidance purposes: clean dishes and placed on the corresponding shelves, refrigerator with no food remains, garbage deposited in the corresponding containers, etc.), all without prejudice to the fact that cleaning was included in the rental price.

"The Client" is obliged to respect the rules of civility and coexistence with the rest of the residents of the property where the house is located, as well as the rules of the Community of Owners. In the event that these rules are not respected or inappropriate behavior, both the property and "APARTAMENTOS77.COM" reserve the right to cancel the lease with immediate effect and without prior notice, without any obligation to refund the amount. paid for the lease.

8.- Claims and emergency solution telephone number

Despite the fact that "APARTAMENTOS77.COM" rigorously informs of the internal regulations of the facilities, use of electrical appliances, dependencies and equipment of the house, and carries out an exhaustive control of the state of the same, in case of any doubt of urgent resolution, damage or incidence in the leased property, "The Client" must immediately notify it through the following notification channels:

If the communication is about any damage, it must be made within a maximum period of 48 hours from the access to the house, "APARTAMENTOS77.COM" not being responsible for any claim that has not been raised within said period.

"APARTAMENTOS77.COM" will immediately attend to any query or incident raised. If it cannot be resolved within a reasonable period of time, "The Client" may file a claim, within a maximum period of 14 days, with the reservations office, stating the name and surname of the person who attended to them during their stay in the House.

Likewise, each home will have Complaints and Claims Sheets available to users, and a poster advertising them in a visible place within it.

"APARTAMENTOS77.COM" will provide users with an emergency telephone number that should ONLY be used in the following cases:

a) Theft.

b) Loss of keys: In this case "APARTAMENTOS77.COM" will send the necessary staff to provide assistance and will apply a charge of € 40 for the assistance provided + € 20 for the cost of the new key.

c) Forgetting keys inside the lock (inside the house): In this case "APARTAMENTOS77.COM" will send the necessary personnel to provide assistance and will apply a charge of € 150 for the service.

d) Water and / or electricity cuts: In this case, the problem will be solved as quickly as possible by a qualified specialist, at no extra cost for the user, unless the fault arises from his negligent action.

9.- Responsibilities attributable to "APARTAMENTOS77.COM"

If the reserved home presents serious deficiencies that prevent its normal use, "APARTAMENTOS77.COM" undertakes to find an alternative solution of similar characteristics and price. If this is not feasible due to lack of available housing or because "The Client" rejects the proposals offered, all or part of the amount of the reservation will be reimbursed depending on the time you have enjoyed the accommodation, without it being possible to attribute to "APARTAMENTOS77.COM "any additional liability.

"APARTAMENTOS77.COM" will not assume any responsibility in the following cases:

a) Negligence or omission of services attributable to third parties.

b) Failures or incorrect operation of swimming pools, playgrounds for children and sports facilities of any kind, leaving the use of these strictly under the responsibility of the user.

c) Theft or theft in the home.

d) Damage to people or things caused by force majeure or unforeseen setbacks for which "APARTAMENTOS77.COM" nor its representatives can respond.

e) Due to the greater or lesser difficulty in accessing the rented homes (country lanes, unpaved, lack of public transport, etc.), the client must check the exhaustive description that is made in this regard in the information sheet of the living place.

f) For the transport or "transfer" services performed by third parties (airport, guides and routes, etc.).

Consequently, the responsibility of "APARTAMENTOS77.COM" is limited to its intermediation function, according to the scope that it has and is effectively developed by it, not assuming any of the responsibilities that legally correspond to the property in terms of the lease of homes per season.

In any case, "The Client" toaccepts that the economic responsibility of "APARTAMENTOS77.COM" for eventual damages, both material and of another nature that may be caused as a result of its intermediation, will always and in any case be limited to the total amount paid for the lease.

10.- Validity and competent jurisdiction

These general conditions are written in Spanish and translated into other languages (French, German, English, etc.), the Spanish version prevailing in case of discrepancies between the translations or doubts about their meaning.

Once the reservation of a home is made, the general conditions accepted by the client will come into force, which will govern the seasonal rental contract between "The Client" and the owner of said home. "APARTAMENTOS77.COM" acts as an intermediary between the two, being responsible for the correct execution of the mediation in accordance with current Spanish legislation.

For any matter arising from the interpretation and effects of the lease and / or these general conditions, the parties voluntarily submit to the jurisdiction of the Courts and Tribunals of Torrox, expressly waiving any other that may correspond to them.
